ATKINSON — Sgt. Nathan Lyons, who also serves as Atkinson's Drug Abuse Resistance Education officer, has resigned from the police department after he was arrested and charged with driving under the influence following a crash in Newton.

Police Chief Al Brackett confirmed Wednesday that Lyons submitted his resignation on Dec. 1, effective immediately.

Lyons, 36, of Plaistow, was suspended without pay after the Nov. 21 crash in Newton while the Atkinson Police Department conducted an internal investigation.

Brackett said that investigation is now closed since Lyons is no longer working for the department. He declined to release a copy of the resignation letter, saying it's part of a personnel file.

Lyons has pleaded not guilty to charges of driving while intoxicated, reckless operation and conduct after an accident.

The DWI charge alleges that Lyons was under the influence of "intoxicating liquor and/or controlled drug, prescription drug, over-the-counter drug, or any other chemical substance, natural or synthetic."

Newton police said Lyons struck a car, failed to stop, and continued driving until he crashed into a utility pole on North Main Street.

Selectman Jason Grosky, the board's chairman, informed selectmen Monday that Lyons had resigned. He didn't mention the pending charges.

"Sgt. Lyons is a friend to many in town, particularly the students he spent so much time with. His prompt resignation spares the town from having his employment status hang in limbo. I appreciate his service, and hope he is on the way back up and headed for a good next chapter," he said Wednesday.

Brackett said the department is still trying to figure out what will happen with the sergeant's position and the D.A.R.E officer's position in the wake of the resignation. Brackett said Lyons was not currently teaching a D.A.R.E program at Atkinson Academy.
