EXETER - A local woman has been indicted for allegedly posting a picture of an 18-year-old’s exposed breast online.

Patrice Maloney, 21, of 136 Kingston Road, faces one felony count of non-consensual dissemination of private sexual images.

It’s the latest case brought under the state’s so-called “revenge porn” law, which was adopted in 2016 and aims to punish those who share private sexual images without the consent of those photographed.

Maloney is accused of posting the image “with the intent to harass, intimidate, threaten or coerce,” according to the indictment handed up this month by a Rockingham County grand jury.

The 18-year-old’s identity could be determined from the image that was shared, the indictment says.

The indictment alleges Maloney obtained the picture “under circumstances in which a reasonable person would know or understand that the person in the image intended that the image was to remain private.”

Maloney also “knew or should have known” that the teen didn’t consent to the dissemination of the picture, the indictment alleges.

The charge is a class B felony that carries a penalty of 3½ to 7 years in prison and up to a $4,000 fine if convicted.
