Convicted sex offender headbutted in court by fellow prisoner

DOVER — A convicted sex offender from Somersworth was headbutted by a fellow prisoner after he pleaded guilty to assaulting a 4-year-old girl Thursday at Strafford County Superior Court.

Christopher Elwell, 29, was charged in June for sexually assaulting the girl at a Dover Housing Authority property on Mineral Park Drive.

The girl was visiting the residence and was one of three young children participating in a sleepover at the time of the assault, police said.

After his arrest, Elwell admitted to staying in a bedroom with the children and watching pornography on his cellphone. He told police the 4-year-old wanted to imitate what was seen on the video.

Prosecutor Emily Conant said Thursday that after Elwell pleaded guilty and received a 7 ½- to 15-year prison sentence with the possibility of having one year suspended if he participates in a sex offender program, Josiah Davies walked up to Elwell and headbutted him as he sat in the back row of the gallery awaiting transport.

Davies, who was arrested in Rochester for forgery and violation of probation, was in the courtroom for a dispositional conference. Because of the attack, his hearing was moved to Dec. 4, Conant said.

Conant said she was not sure if Elwell needed medical treatment after the incident.

Davies is being held on $100,000 cash bail, Conant said.

Elwell will have an additional 7 ½ to 15 years suspended for 15 years after his release, Conant said.

He is also not allowed to have unsupervised contact with children.

Elwell was convicted of two counts of felonious sexual assault in 2008 after he pleaded guilty to engaging in sexual acts with a 14-year-old.
