Hearing set for Abby Hernandez's alleged kidnapper

OSSIPEE — A judge has set Sept. 9 for a probable cause hearing for Nathaniel E. Kibby, who is charged with kidnapping Conway teenager Abigail Hernandez last fall.

On Monday, Justice Pamela Albee, who had previously granted Kibby, 34, of 4 Brookside Drive in Gorham, a 30-day continuance of his probable cause hearing, scheduled the hearing for Sept. 9 at 9 a.m. in 3rd Circuit Court-District Division-Ossipee.

Albee granted the continuance on Aug. 8 at the request of Jesse Friedman, Kibby’s public defender. In his motion, Friedman wrote that the defense and the prosecution were talking about “the dissemination of discovery materials.”

Friedman and co-counsel Allison Schwartz now have all three search warrants that Albee granted for the search and seizure of items from Kibby’s mobile-home in the Gateway Trailer Park, as well as a metal storage trailer on the property and also the original arrest warrant. All of those documents remain sealed.

During the probable cause hearing, the public should learn more about what happened to Hernandez.

To date, the only thing known publicly as to why the state charged Kibby with kidnapping Hernandez is a one-page complaint alleging that on Oct. 9, 2013, Kibby took then 14-year old Hernandez as she walked home from Kennett High School where she was a freshman.

Almost mysterious as Hernandez’s disappearance was her reappearance on July 20 to her North Conway home. Eight days later, Kibby was arrested at his residence and charged with one count of Class B Felony kidnapping.

At Kibby’s July 29 arraignment before Albee in Conway District Court, Friedman — citing his inability to learn about the state’s charges against his client — entered “no plea” on his behalf.
