North Hampton man to plead guilty in child porn case, lawyer says


BRENTWOOD — A North Hampton man intends to admit to possessing child pornography but is asking a judge to allow him to remain free on bail before he is sentenced, according to court records.

Matthew Morvillo, 55, has struck a plea deal with federal prosecutors in U.S. District Court and hopes to resolve similar charges in superior court stemming from a raid at his home last July 12, his lawyer, Kyle Patrick Griffin indicated in court filings..

Griffin asked a federal judge on Wednesday to allow Morvillo to remain free on bail following his client’s plea hearing on May 16 so he can take care of “financial affairs” before being incarcerated.

“Throughout the duration of this matter, Mr. Morvillo has known a period of incarceration is imminent,” Griffin said in court papers. “He has continued to reside at his home in North Hampton. Mr. Morvillo has had possession of his passport and had financial means to travel anywhere yet has remained local.”

Terms of the plea agreement have not been made public, but Griffin has suggested in court papers that a disposition in federal court might lead to state charges being dropped against his client.

“He is ready and willing to accept responsibility for the crime for which he is charged,” Griffin noted in Wednesday’s court filing.

North Hampton police executed a search warrant on Morvillo’s home last July 12, and found a collection of compact discs next to a home computer, prosecutors said.

The discs were manufactured outside New Hampshire and “contained primarily images and videos of children under the age of 18 engaged in sexual conduct,” prosecutors said.

County prosecutors indicted Morvillo on a single count of possession of child sexual abuse images, alleging that last Feb. 21 he had an image of a boy exposing himself on a bed.

Morvillo faces up to 7 ½ to 15 years in prison if the state goes forward in that case.

Federal prosecutors could argue for up to a 10-year prison term, but acknowledged that a lesser sentence would be recommended in light of the guilty plea.
