Former Derry administrator will face trial for indecent exposure


DERRY — A trial management conference was held Friday for former Town Administrator John Anderson, who faces charges of indecent exposure and lewdness.

After the conference in the 10th Circuit Court in Derry, the decision was made that the trial will continue and be set for a full day, a court official said Friday. The date of the trial has yet to be scheduled.

During the conference, Anderson's attorney James Rosenberg and prosecutor Kirsten Wilson were scheduled to meet with Judge Lucinda Sadler to discuss how much court time would be needed for the trial, according to court officials.

Rosenberg requested that the misdemeanor charges of indecent exposure and lewdness be dropped on March 7 during a hearing in the 10th Circuit Court. That request was rejected by Sadler and the management conference was then scheduled.

Anderson, 50, has plead not guilty to the misdemeanor charges of allegedly inviting a DirecTV salesman into his house on July 11 while in the nude and other inappropriate conduct.

Rosenberg had argued on March 7 that the state indecent exposure statute is vague and uses overbroad language. Rosenberg said the salesman, who didn't have an appointment, also continued to pitch the satellite TV product inside the home.

After leaving, the salesman allegedly left behind a brochure for Anderson with his own phone number handwritten on it, Rosenberg said.

Wilson had argued previously that the state statute isn't overly broad or vague.

Wilson had also argued that Anderson had crossed the line when he invited the salesman into his home while in the nude and allegedly acted inappropriately in front of the salesman.

Anderson remains free on $2,000 personal recognizance.
