Testimony ends in trial of ex-Dartmouth student

HAVERHILL - A Grafton County Superior Court Judge Peter Bornstein Tuesday dismissed two of seven sexual assault charges against a former Dartmouth College student.

Later in the day, both the prosecution and defense rested their cases after seven days of testimony in the matter of Parker C. Gilbert, 21, of London, England.Gilbert still faces five counts of aggravated felonious sexual assault against an 18-year-old student who said she was sleeping in her dormitory room last May 2 when she awoke in the early-morning hours to find Parker, then a member of the Big Green rugby team, sexually assaulting with her.The alleged victim from Connecticut has also since left Dartmouth but returned to New Hampshire last week to provide emotional testimony that Gilbert had no permission to enter her unlocked room that night last spring. She told jurors he refused repeatedly to cease attacking her when she asked him several times to stop.Defense attorneys say the encounter was consensual sex between two students who had been drinking and had seen each other earlier in the night at a campus fraternity party.Gilbert also faces a Class A misdemeanor count of criminal trespassing on the night of the alleged attack.Bornstein is expected to deliver instructions to the jury today, before attorneys for both sides present their closing arguments and the jury begins
