Winchester man files to plead guilty in crash that killed his brother

KEENE — A Winchester man has filed a motion to plead guilty to negligent homicide (driving while intoxicated) in connection with an April crash that killed his brother.

Lynn Pickard, 38, of Fullam Pond Road, Winchester, was recently indicted by the Cheshire County Superior Court Grand Jury on four charges alleging he caused the April 24 crash of a 2009 Toyota Corolla in Winchester that caused the death of a passenger, his brother, Terry Pickard.

Pickard was indicted on two counts of negligent homicide that allege he caused his brother’s death by driving under the influence of alcohol or drugs and that he drove at an unreasonable speed for the road conditions. He also faces two counts of aggravated driving while intoxicated alleging Pickard drove with a blood alcohol level above the legal limit of 0.08.

A motion to plead to one count of negligent homicide (DWI) was filed in superior court on Wednesday. The motion of a capped plea asks for a sentence of 1½ to 5 years in prison.

Pickard’s bail was also reduced from $10,000 to $2,000, which he posted and was released from jail.

He is scheduled to appear in superior court Feb. 5, 2014, for a plea and sentencing hearing.
