BRENTWOOD — A Portsmouth teen who police say drugged a 15-year-old girl and raped her while the two were in a wooded area near South Cemetery in Portsmouth was indicted on a sexual assault charge.

Grant Michallyszyn, 17, was indicted on a single count of aggravated felonious sexual assault for allegedly forcing himself on the girl on July 10, according to court records.

Portsmouth police say Michallyszyn gave the girl a quantity of Clonazepam prior to the assault.

The indictment, made public this week, does not mention the drug, but says that the girl was "physically helpless to resist" Michallyszyn during the assault.

The girl was given the drug while in the woods with Michallyszyn, and the assault happened there as well, according to a police affidavit.

Police learned about the alleged assault from a tip through Crime Stoppers.

Michallyszyn was arrested in August on charges of aggravated felonious sexual assault and possession of a controlled drug with intent to sell.

At the time, he was already being held in county jail on another drug charge brought by New Hampshire State Police.

A circuit court judge ordered that Michallyszyn have no contact with the girl or her family. He was also ordered to have a 7 p.m. curfew and report weekly to probation officials.

The aggravated felonious sexual assault charge is punishable by up to 10 to 20 years in state prison, according to prosecutors.

Michallyszyn, who is free on bail, will be expected to appear for arraignment later this month in Rockingham County Superior Court.
