Supreme Court upholds joggers prior ban from Portsmouth
PORTSMOUTH — The New Hampshire Supreme Court upheld a judge’s order that once banned a jogger from Portsmouth while he faced charges for yelling profanities at officers and random civilians, while jogging city streets. Jogger Craig O’Brien, of Eliot, Maine, had argued to the state’s highest court that when he was banned from Portsmouth by Judge Sawako Gardner, the order infringed on his state and federal constitutional right to intrastate travel.
