Plaistow lawyer may face more charges in boating crash

BRENTWOOD — Prosecutors have until January to bring more charges against a Plaistow lawyer accused of causing a fatal boating crash that killed a 54-year-old Merrimack man last May, according to a judge’s order.

Lawrence Buswell Jr., 52, of Kingston has pleaded not guilty to a misdemeanor vehicular assault charge for allegedly crashing his boat into a Sea Ray boat on Country Pond in Kingston last May 26.

The crash happened last May 26 about 11:30 p.m., injuring five people in the other boat and killing Eric Eskeland of Merrimack.
Judge N. William Delker wrote in an order that prosecutors “shall seek additional or alternative charges by January grand jury.”

Delker briefly met with lawyers connected to the case on Wednesday, and set a June 23 trial date in Rockingham County Superior Court.
Prosecutors told a judge back in May that they were filing the pair of misdemeanor charges because the statute of limitations was about to expire, but planned on seeking felony charges once their investigation was complete.
Buswell was allegedly piloting a 20-foot Correct Craft powerboat “at a rate of speed which prohibited him from being able to observe a boat, specifically a Sea Ray, directly in front of him,” according to court complaints.
At this point, Buswell only faces a pair of Class A misdemeanors, punishable by up to a year in county jail or $2,000 fine.

Buswell is also facing charges in a second case for the alleged rape of a 15-year-old boy while the two were in his boat on Country Pond sometime between July and August 2011.
Police say the Buswell took the boy swimming and gave him shots of Apple-flavored vodka then forced the boy to commit sexual acts.

The sex assault charges are punishable by 3½ to 7 years in state prison.
Buswell has pleaded not guilty in both cases and remains free on bail.
