Derry man misses sentencing hearing in Christmas day assault on infant

MANCHESTER — A Derry man who reached an agreement to plead guilty to assaulting a 2-month-old infant on Christmas Day 2012 failed to appear at his sentencing in Hillsborough County Superior Court Monday.

The court issued an arrest warrant against Brian P. Reeves for defaulting on the his court appearance.

Reeves, 34, 23L Kendall Pond Road, Derry, was indicted last February of second-degree assault for allegedly slapping the infant girl across the face inside a 284 Spruce St. apartment. The child suffered bruises and a swollen eye. Reeves is not the father of the child. The state sought an extended 10- to 30-year term if Reeves is convicted of the Class B felony.

Reeves reached a negotiated agreement with the state on May 31 in which he agreed to plead guilty to the felony in exchange for the state recommending he serve a 2- to 7-year prison term, court records show. If the court rejected the plea deal, a prosecutor said the state would recommend Reeves serve a maximum 7-year prison term.
