Man plans to claim self-defense in fracas outside of The Page in Portsmouth


BRENTWOOD — A Portsmouth man charged with first-degree assault for allegedly kicking another man in the head outside of the now-defunct The Page Restaurant and Bar last July will claim he was defending himself from being attacked by the alleged victim.

Josiah Mayo, 25, notified a judge on Monday that he plans to claim self-defense during his Sept. 30 trial in Rockingham County Superior Court on charges of first- and second-degree assault.

Mayo is accused of getting into a fight with Zachary Green around 1 a.m. July 15, 2012, and fracturing his skull. Police say that Mayo and Green left The Page and met in the Vaughan Mall before the confrontation.

Witnesses told police that they saw a black male with curly hair and a black shirt punch and kick Green.

Green was found unconscious at the scene. He was taken to Portsmouth Regional Hospital and put in the intensive care unit for treatment.

Mayo has pleaded not guilty to the charges and remains held at the Rockingham County jail in Brentwood.

He was arrested last September by Portsmouth police. At the time, he was being held in Maine on a probation violation.

Prosecutors submitted a witness list with 21 people who could be called to testify at Mayo’s trial.

Court documents say Mayo rejected a plea offer to settle the case and decided to go to trial to contest the charges.

Prosecutors offered to recommend a 3½- to 7-year state prison sentence for Mayo in exchange for a guilty plea, according to court records.

Mayo faces up to 7½ to 15 years in prison if convicted of first-degree assault.

The Page closed its doors permanently on June 21 in the wake of another assault inside the restaurant earlier this year that led to the death of 24-year-old Joshua Krantz of Dover.
