I might well have reached a different conclusion in this case if I had reviewed this matter de novo. Viewed with the benefit of hindsight, it is quite clear that this is a trivial dispute that could have been avoided if counsel on both sides had worked co operatively to solve the problem. While the Magistrate Judge’s fee award in this case was not clearly erroneous, the Disability Rights Center is not free from blame.
