Home care worker indicted for kidnapping, sexual assault of male client

BRENTWOOD – A former home care worker has been indicted for kidnapping and sexually assaulting a mentally handicapped male client under his care, prosecutors said.

John Riley, 41, of Milton, was indicted on five charges for sexually assaulting the 35-year-old man at a Portsmouth parking lot on Nov. 2.

Riley was working for Living Innovations, an agency that provides care for the elderly and people with developmental disabilities, when the alleged attack occurred.

Police say Riley had the victim in his car after a Halloween-themed dance hosted at Living Innovations offices at 1950 Lafayette Road in Portsmouth.

Riley pulled over in the parking lot of a Home Depot store on Brady Avenue on his way home and performed a sex act on the victim against his will, according to police. Riley allegedly showed nude pictures of himself kept on his cellphone to the victim, police said.

The victim told Riley, “No,” and said, “I don’t want to do anything,” during the assault, according to an indictment.

About a month prior to his arrest, Riley was recognized as the Direct Support Professional and Home Provider of the Year, according to a newsletter by the New Hampshire Council on Developmental Disabilities.

Prosecutors have sought an enhanced felony on the sexual assault charges, making them each punishable by up to 10 to 20 years in state prison if Riley is convicted by a jury. The kidnapping charge carries a potential 3 ½ to 7 year prison term.

The remaining charges of false imprisonment and indecent exposure are misdemeanors.

Riley has remained free on $30,000 cash bail. Part of Riley’s bail conditions requires him to have no contact with Living Innovations, court records say.

He will be arraigned on the charges later this month in Rockingham County Superior Court.
