May 06. 2013 9:07AM

LACONIA - A 64-year-old convicted sexual offender is now facing charges of rape, with police accusing him of sexually assaulting a mentally disabled man.

Roger Toutaint, 289 Hillcrest Drive, was indicted by a Belknap County Superior Court jury on three counts of aggravated felonious sexual assault and five misdemeanor charges of simple assault.

The alleged sexual assaults happened six to seven years ago, between April 19, 2007, and Jan. 1, 2008, in Gilmanton when the man was in his early 40s.

Toutaint is accused of sexually assaulting the man whom he knew was a "mentally defective individual" and was physically helpless to resist, according to indictments released Monday.

Toutaint was convicted July 7, 2011, in Belknap County Superior Court on two counts of sexual assault of an individual over the age of 13. He is listed in the database of New Hampshire sexual offenders.
