State Supreme Court overturns DES decision

LACONIA - The New Hampshire Supreme Court has vacated a decision to deny unemployment benefits to a former city code enforcement officer who was fired in June 2011, a month after his arrest on drunk driving charges.

The court ruled that the Department of Employment Security and an appeals tribunal each erroneously interpreted state law when denying Stewart's claim by saying he didn't have enough earnings to qualify for benefits.

Stewart was the city's code enforcement officer from March 14 to June 29, 2011. He was charged May 28 with driving while under the influence of alcohol or drugs.
