Homeless man in Middleton standoff indicted

DOVER - A homeless man who police say held a Middleton woman at gunpoint with an AK-47 in January could face more than 80 years in prison.

Richard Penney, 35, who remains in the Strafford County jail, was charged with robbery, two counts of theft by unauthorized taking, kidnapping and criminal threatening in connection with the incident, which resulted in a three-hour standoff with local and state police near Sunrise Lake in Middleton Jan. 31.

A Strafford County Superrior Court grand jury handed up the indictments April 18.

After walking to his brother's home on Elaine Drive in Middleton, Penney, who previously lived in town, allegedly took a .32 caliber Barretta pistol and a .22 caliber derringer Model DM-22. He then threatened to allegedly "blow his brains out" with the loaded Barretta if his brother - Robert - did not hand over an AK-47 rifle, according to court records.

Penney then left his brother's home with loaded weapons and additional ammunition and allegedly forced his way inside the woman's nearby home - which was along Lakeshore Drive, police said. Penney eventually let the woman go unharmed before surrendering to police.

Penney, who has been held on $500,000 cash bail since his arrest, is scheduled to be arraigned in Strafford County Superior Court May 2 at 9 a.m.

Robbery, theft by unauthorized taking and kidnapping are all class A felonies, which could each yield a sentence of up to 7 to 15 years in prison. Criminal threatening is a class B felony, which could result in up to 3 to 7 years in prison.
